Mini Skip Bins acts as both a supplier and agent for the bin suppliers listed on our website. We are authorized to enter into binding contracts for the supply and services on behalf of these suppliers and to collect payments on their behalf.
2. FEES AND CHARGES
2.1 The Customer will pay the Specified Fees to Mini Skip Bins for the agreed services provided by the nominated supplier, as detailed in this Agreement.
2.2 Fees and charges are inclusive of GST unless otherwise stated for the Specified Fees or Additional Charges.
2.3 The Customer acknowledges the possibility of incurring Additional Charges, as detailed in Clause 3, in addition to the Specified Fees.
3. ADDITIONAL CHARGES
3.1 Additional Charges payable by the Customer include: (a) Charges for tipping fees, special tipping fees, Excess Loading Fees, handling charges, and costs associated with Prohibited Materials. (b) Restricted Delivery / Collection Fees. (c) Excess Retrieval Fees if the Skip Bin is not available for collection on the agreed Collection Date.
3.2 Additional Charges will be reasonable and conform to standard fees charged by the supplier.
4. PAYMENT
4.1 The Customer must pay the Specified Fees to Mini Skip Bins at the time of ordering.
4.2 Additional Charges must be paid to the supplier before the bin is removed from the property after invoicing.
4.3 The Customer authorizes Mini Skip Bins to charge their credit or debit card for both the Specified Fees and any Additional Charges.
4.4 A Tax Invoice will be provided by Mini Skip Bins in accordance with GST Legislation.
5. CUSTOMER OBLIGATIONS
The Customer agrees: (a) To use the Skip Bin responsibly and sensibly. (b) To be responsible for any loss, damage, or destruction of the Skip Bin while it is in their care. (c) To return the Skip Bin in the same condition as when delivered, allowing for fair wear and tear. (d) To make the Skip Bin available for collection on the agreed Collection Date. (e) That legal title to the Skip Bin remains with Mini Skip Bins. (f) Not to encumber or charge the Skip Bin. (g) Not to create any interest in the Skip Bin. (h) To use the Skip Bin only for Specified Waste Materials. (i) To obtain all necessary approvals and permits for the bin’s delivery and placement. (j) To assume all liability for issues related to the Skip Bin’s placement, including trespass and nuisance. (k) To be responsible for all materials deposited in the Skip Bin, including those deposited by unauthorized individuals. (l) That Mini Skip Bins is not liable for disposal issues and indemnifies Mini Skip Bins from such liability. (m) That title to the contents remains with the Customer if Prohibited Materials are present until properly disposed of. (n) If Prohibited Materials are present, the supplier may return the contents or the bin with Additional Charges until properly disposed of.
6. RESTRICTIONS ON USE OF SKIP BINS
The Customer must not: (a) Place Prohibited Materials in the Skip Bin. (b) Light fires or burn materials in the Skip Bin. (c) Overfill the Skip Bin so materials protrude above its top. (d) Relocate the Skip Bin without authorization. (e) Use the Skip Bin for illegal purposes. (f) Use the Skip Bin for any purpose other than disclosed and agreed upon.
7. CANCELLATION AND REFUND
7.1 Cancellations or variations must be made in writing at least 24 hours before the Delivery Date, incurring a $35 Administration Fee. Cancellations on the Delivery Date will incur reasonable costs as determined by the supplier.
7.2 Variations are subject to the supplier’s discretion and may incur additional fees and costs.
7.3 No refund will be provided for cancellations or variations made without adequate notice.
7.4 Mini Skip Bins may cancel the order if the supplier cannot fulfill it. In such cases, a full refund will be provided.
7.5 Mini Skip Bins may cancel the Agreement if access is restricted, or conditions are dangerous, with no further liability except for Delivery / Collection Charges.
7.6 If the Skip Bin contains Prohibited Materials, is overloaded, or fees are unpaid, the supplier may terminate the Agreement and dispose of contents at the Customer’s risk.
8. RISK
The Customer is fully responsible for loss, damage, or destruction of the Skip Bin while it is in their care, subject to fair wear and tear.
9. SITE ACCESS AND CONDITIONS
9.1 The Customer must ensure reasonable access to the Site Address and obtain all necessary consents for the Skip Bin’s delivery, placement, and removal.
9.2 Mini Skip Bins and the supplier are not responsible for damage to surfaces or access areas at the Site Address.
10. ASSIGNABILITY
The Agreement cannot be assigned by the Customer without written consent from Mini Skip Bins.
11. INDEMNITIES BY CUSTOMER
The Customer will indemnify Mini Skip Bins against all loss, damage, or injury arising from breaches of these terms or misuse of the Skip Bin, excluding negligence by Mini Skip Bins.
12. COMPLIANCE WITH THE LAW & ASSOCIATED INDEMNITIES
The Customer must comply with all relevant laws and indemnify Mini Skip Bins and the supplier against actions, costs, claims, and demands arising from non-compliance.
13. IMPLIED STATUTORY TERMS & LIMITATION OF LOSSES
13.1 Implied statutory terms are excluded to the extent permissible by law.
13.2 If the services are not for personal, domestic, or household use, the supplier’s liability is limited to: (a) Supplying the service again; (b) Providing equivalent goods or services; (c) Payment for the cost of supplying the services again.
14. PROPER LAW OF CONTRACT
This Agreement is governed by the laws of South Australia. The parties submit to the jurisdiction of South Australian Courts.
15. INTERPRETATION
Definitions:
Additional Charges: Charges outlined in Clause 3.1.
Additional Weight Charges: Fees for exceeding the prescribed weight.
Agreement: This document’s terms and conditions.
Collection Date: The agreed date for collection of the Skip Bin.
Delivery Date: The date for delivery of the Skip Bin.
Delivery Period: The period from Delivery Date to Collection Date.
Excess Loading Fees: Fees for overfilled Skip Bins.
Excess Retrieval Fees: Costs for extended use of the Skip Bin.
GST Legislation: The A New Tax System (Goods and Services Tax) Act 1999 and related regulations.
Prohibited Materials: Includes liquids, explosives, hazardous materials, radioactive materials, and any other prohibited substances listed on the Website.
Restricted Delivery / Collection Fees: Additional costs due to restricted access or dangerous conditions.
Skip Bin: A waste bin for delivery, disposal, and collection of materials.
Specified Fees: Fees specified on the website or quoted by Mini Skip Bins.
Site Address: The location for the Skip Bin delivery.
Specified Skip Bin: The type and size of the Skip Bin as agreed.
